Terms of Service

1. Acceptance
By accessing or using Mazel ("the Service"), you agree to be bound by these Terms of Service. If you are using Mazel on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
If you do not agree, do not use the Service.
2. Description of service
Mazel is a software-as-a-service (SaaS) CRM platform for Jewish matchmaking organizations. It provides tools for managing singles profiles, tracking match suggestions, team communication, and related workflows.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where possible.
3. Accounts and access
- Age requirement: You must be at least 18 years of age. By creating an account, you confirm that you are 18 or older.
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the security of your login credentials. Do not share your password.
- You are responsible for all activity that occurs under your account.
- Organization administrators are responsible for the accounts and actions of their team members.
- You must provide accurate information when creating an account. Do not impersonate others.
4. Acceptable use
You agree not to use Mazel to:
- Violate any applicable law or regulation
- Store or share data about individuals without appropriate consent
- Harass, abuse, or harm any person
- Upload malicious code, viruses, or any harmful software
- Attempt to gain unauthorized access to any part of the platform
- Reverse engineer or copy the platform's source code
- Resell, sublicense, or commercially exploit the Service without written permission
5. Your data
You own the data you put into Mazel. We do not claim ownership of singles profiles, notes, messages, or any other content you create.
By using the Service, you grant us the limited right to store and process your data solely to provide the Service to you, as described in our Privacy Policy.
You represent and warrant that you have obtained all necessary consents, permissions, or legal authority required by applicable law to collect, store, and process personal information about any third party you enter into the Service. You agree to indemnify and hold Mazel harmless from any claims arising from your failure to obtain such consents.
6. Subscriptions and billing
- Mazel is a paid subscription service. Pricing is listed on the website and subject to change with 30 days' notice.
- Subscriptions are billed monthly or annually depending on your plan.
- Payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method on a recurring basis.
- Refunds are not provided for partial months. If you cancel, you retain access until the end of your current billing period.
- We reserve the right to suspend access if payment fails and is not resolved within 7 days.
7. Cancellation and termination
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
We may terminate or suspend your account if:
- You breach these terms
- Your payment fails and is not resolved
- We are required to do so by law
Following termination, personal data will be handled in accordance with our Privacy Policy. You may request a data export by contacting privacy@mazelcrm.com within 30 days of termination.
8. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.
9. Limitation of liability
To the maximum extent permitted by law, Mazel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the Service.
Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms limits liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be excluded or limited under applicable law.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these terms by reference.
11. Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you via in-app notice and, where available, by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
12. General Provisions
Dispute Resolution and Arbitration. PLEASE READ THIS CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising from or relating to these Terms or the Service (except claims for injunctive relief relating to intellectual property) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. YOU AND KESHER EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. This arbitration agreement does not prevent you from bringing issues to the attention of federal, state, or local agencies.
Governing Law. These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any claims not subject to arbitration shall be resolved in the state or federal courts located in New York County, New York.
Severability. If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Mazel regarding the Service and supersede all prior agreements and understandings.
Force Majeure. Neither party shall be liable for failure or delay in performance due to causes beyond their reasonable control, including natural disasters, pandemics, acts of government, infrastructure failures, cyberattacks, or other force majeure events.
Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets, provided the acquiring entity agrees to honor these Terms.
Indemnification. You agree to defend, indemnify, and hold harmless Mazel and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms; (b) content or data you submit through the Service; or (c) your violation of any third party's rights, including rights of individuals whose personal data you enter into the Service.
